This Policy applies to Fidelis Solutions Group, LLC, Fidelis Advisory Services, LLC (loan brokerage), Fidelis Tax and Accounting, Fidelis Capital Services (inactive), Fidelis Wealth AI, LLC and Fidelis Wealth Group, LLC (investment advisory), and The Phoenix Program, and to the Fidelis Ledger platform and all associated websites and applications.

2. Information We Collect

We collect personal information necessary to provide financial, tax, lending, and advisory services, including:

  • Identity data: full name, date of birth, government-issued ID numbers.
  • Contact data: email address, mailing address, phone number.
  • Tax identification data: Social Security Number (SSN) or Employer Identification Number (EIN), collected for tax preparation, IRS filings, and loan applications where legally required.
  • Financial account data: account numbers, balances, transaction history, and investment holdings, collected via Plaid or MX financial data aggregation services with your express authorization.
  • Lending application data: credit-related information, income and employment details, business financial statements, and other underwriting data submitted in connection with a loan inquiry.
  • Usage data: IP address, browser type, device identifiers, and pages visited on our platforms, collected automatically via cookies and similar technologies.

We do not sell personal information to third parties, and we do not collect sensitive personal information beyond what is necessary to provide the services you request.

3. How We Use Your Information

We use your personal information to:

  • Provide, maintain, and improve our tax, lending, wealth planning, and bookkeeping services.
  • Process applications and fulfill service engagements.
  • Communicate with you about your account, transactions, and service updates.
  • Comply with applicable federal and state laws, including IRS regulations, Circular 230, applicable state lending and loan-broker regulations, the Gramm-Leach-Bliley Act, the Bank Secrecy Act, and anti-money-laundering obligations.
  • Detect, prevent, and investigate fraud or other illegal activity.
  • Improve our platforms and user experience through analytics.
  • Send you educational or informational communications where you have consented or where permitted by applicable law.

4. Information Sharing

We do not sell your personal information. We may share your information with:

  • Lending partners: for loan applications, we share relevant application data with third-party lenders and lending networks solely to facilitate the loan inquiry you initiated. Fidelis Advisory LLC acts as a loan broker and is not a lender.
  • The IRS and other government authorities: tax return information, IRS Form 8821 authorizations, and related data are transmitted to the IRS and applicable state taxing authorities as part of tax preparation and representation services.
  • Service providers: we share data with technology vendors, cloud infrastructure providers, financial data aggregators (Plaid, MX), and professional service firms acting on our behalf under confidentiality obligations.
  • Fidelis affiliates: affiliated Fidelis entities may share information to provide coordinated services, subject to this Policy.
  • Legal requirements: we may disclose information when required by law, subpoena, court order, or regulatory examination.

5. Data Retention

We retain personal information for as long as necessary to provide services and to comply with our legal obligations. Financial services records, including tax returns, loan applications, and investment account records, are generally retained for a minimum of seven (7) years in accordance with IRS regulations, SEC recordkeeping rules, and applicable state law. Some records may be retained longer where required by law or legitimate business need.

When retention periods expire, we securely delete or de-identify personal information.

6. Your Rights

Depending on your state of residence and applicable law, you may have certain rights regarding your personal information:

  • Access: you may request a copy of the personal information we hold about you.
  • Correction: you may request that we correct inaccurate or incomplete information.
  • Deletion: you may request deletion of your personal information where legally permitted. Note that legal and regulatory recordkeeping obligations may limit our ability to delete certain records.
  • Opt-out of marketing: you may opt out of marketing communications at any time by following the unsubscribe instructions in any email or by contacting us directly.

No system is completely secure, and we cannot guarantee the absolute security of your information.

We may update this Privacy Policy from time to time. We will notify clients of material changes by posting an updated Policy on this page with a revised effective date. Continued use of our services after any changes constitutes acceptance of the updated Policy.
